Thinking about bankruptcy can be stressful! 

But it doesn’t have to be.  We work hard to make sure that we know what your goals are, and that you understand how we can help you using the power of bankruptcy to tame your debt problems.

Some lawyers think of bankruptcy as the first or ONLY debt solution they consider.  We simply won’t do that.  In your very first consultation we can usually assess whether or not bankruptcy is a good option for you to consider. But if we think you have better options than bankruptcy, we will let you know that too.  This gives you what you want: you BEST options and the right advice to pick the right solution.

 

Types of bankruptcy we handle:

  • Chapter 7: a/k/a “straight” bankruptcy or “liquidation” bankruptcy. A Ch. 7 bankruptcy allows you a “fresh start” with a discharge of your debt in a relatively short time. Usually this takes less than a year from start to finish.)  This bankruptcy is often best for those with lower incomes, but high debt on credit cards and similar unsecured debt.
  • Chapter 13 a/k/a a “payment plan” bankruptcy. A Ch. 13 bankruptcy allows you to set up a payment plan to pay your creditors over time typically 5 years, and sometimes less.  This type of bankruptcy makes sense especially when you are behind on a mortgage or a car loan, or you own more assets that you want to keep than you can protect with Ch. 7 bankruptcy exemptions.  Ch. 13 may cost a bit more, but in general provide flexibility that a Ch. 7 bankruptcy doesn’t always have.  For example if you are trying to save a home or car that is about to be repossessed by a creditor, Ch. 13 is often the best option.
